California Long-Stay Hotel Taxes: Written Agreements and Local TOT Rules
Published Oct 30, 2026
California hotel transient occupancy tax, or TOT, is a local question. The sources here describe unincorporated Los Angeles County and unincorporated Monterey County. They do not establish the rules for incorporated cities such as Los Angeles, West Hollywood or Beverly Hills. In both county examples, a timely written agreement for a stay longer than 30 days can matter to the first month's tax.
Unincorporated Los Angeles County
The County's official over-thirty-day application quotes County Code section 4.72.020 L: the occupant is treated as transient for the first 30 days unless there is a written agreement with the hotel operator for more than 30 days. That agreement must be completed within the first 30 days. The form requires both occupant and operator signatures. It also states that the occupant becomes liable for TOT at checkout if the stay does not go beyond thirty consecutive days.
Unincorporated Monterey County
Monterey County's FAQ expressly limits its TOT to unincorporated areas. It says a written agreement entered into within the first 30 days, providing for more than thirty consecutive calendar days, exempts the first 30 days. The operator must retain its completed exemption form and written agreement. A blanket claim that the first month can never be exempt would miss this condition.
County rules do not govern every city in the county
Los Angeles County's TOT page says its tax applies only in unincorporated areas. Incorporated cities can have their own ordinance and rates. The same jurisdiction check is needed elsewhere: a mailing address containing a county or city name is not enough to choose the applicable tax rule.
What to put in the booking record
- Identify the hotel's exact taxing jurisdiction.
- Ask whether a written long-stay agreement is needed and by what deadline.
- Obtain the operator's signature where required, rather than relying on your own unsigned declaration.
- Ask what happens if the stay ends early and whether the first month becomes taxable.
- Separate TOT from any other assessment, fee or tax.
Budget from the agreement, not a slogan
Use the property's written, jurisdiction-specific explanation to budget the first and later billing cycles. Do not assume either that all California hotel tax disappears automatically on day 31 or that the first month must always remain taxed. The two county sources show why both shortcuts can be misleading.
