Illinois Hotel Taxes on a Monthly Stay: The 30-Day State Exemption

Published Oct 30, 2026

Illinois is friendlier to the monthly guest than New York or Florida: the state's Hotel Operators' Occupation Tax applies only to sleeping-room rentals of fewer than 30 consecutive days. Stay 30 consecutive days or more in the same hotel and you count as a permanent resident, outside the state tax. The rules below come from the Illinois Department of Revenue and the Illinois Administrative Code, checked on October 30, 2026. Local taxes - above all Chicago's - are a separate layer with their own rules.

The right to occupy for 30 days matters

IDOR defines a permanent resident as a person with the right to occupy any room in a hotel for at least 30 consecutive days. When there is a binding contract with a permanent resident for at least 30 days, no hotel tax is due. If the contract ends before the first 30 days are complete, the operator owes hotel tax for the period before termination.

A refund can include the first 30 days

If a guest stays 30 consecutive days or more and has paid hotel tax, IDOR says the guest has a legal right to request a refund from the hotel. The operator should refund it on request. IDOR does not refund hotel tax directly to hotel guests. This is not merely a rule that turns off tax on future nights.

When the length of stay was initially uncertain

IDOR explains that an operator may initially owe tax while it is unknown whether the guest will complete 30 days. If the guest later qualifies, the operator can deduct the relevant receipts on a later return. Ask for a guest-level credit or refund, not merely reassurance that the hotel will adjust its own tax return.

Keep the local layer separate

This guide addresses Illinois Hotel Operators' Occupation Tax. Ask the hotel to identify every additional city or other local tax and its own rules. A state exemption should not be applied to a different tax without checking that authority.

  • Keep the binding contract and uninterrupted occupancy records.
  • Request any eligible refund from the hotel in writing.
  • If plans shorten below 30 days, ask for a revised tax-inclusive total.
